A group of Sparta, Georgia, property owners announced they have teamed up with the Institute for Justice (IJ) to challenge a private railroad’s attempt to take their land for a rail spur that would benefit a private business. IJ will represent Don and Sally Garrett, Blaine and Diane Smith, and Marvin and Pat Smith in a legal proceeding before the Georgia Public Service Commission against Sandersville Railroad’s attempt to use eminent domain to condemn and take their land.

Georgia Supreme Court Rules Lactation Licensing Law Unconstitutional

This morning, the Supreme Court of Georgia unanimously ruled that a law requiring lactation care providers to obtain a state-issued license is unconstitutional and violates Georgian’s right to earn an honest living.

The law, which was the first-of-its-kind in the nation, would have forced hundreds of women out of work—including Mary Jackson, a lactation care provider with more than three decades of experience. Together with Reaching Our Sisters Everywhere (ROSE), the nonprofit she helped found to educate families of color about breastfeeding, Mary challenged the license to stand up for her right to economic liberty and protect access to breastfeeding care for all moms and babies.

Today’s ruling shows that courts look at the real-world implications of laws and are willing to strike those that harm the public.

Trained Volunteers Threatened for Giving FREE Legal Advice

The problem? The sort of advice contemplated by Upsolve’s new project, where trained community advocates provide one-on-one advice, is a crime. If Reverend John (or anyone like him) gives someone advice about how to respond to a lawsuit, it could land him in jail for up to four years for engaging in the “unauthorized practice of law.”

That is why Reverend John and Upsolve have teamed up with the Institute for Justice to challenge New York’s prohibition on legal advice from people who are not lawyers under the First Amendment. After all, it cannot be a crime simply to give someone advice—if it were, the nation’s jails would be filled with bartenders, barbers, and meddling aunts. The reason the nation’s aunts walk free is that the First Amendment protects everyone’s right to provide each other with useful advice—including on important topics like their legal rights.

Class Action Lawsuit that Stopped Philadelphia’s Forfeiture Machine Ends with Victims Compensated and Unclaimed Funds Donated to Charities

Nearly a decade after a Philadelphia family launched a lawsuit to save their home from the city’s abusive forfeiture program, the case ends with reforms in place to protect property owners, compensation paid out to victims of the city’s forfeiture machine, and a distribution of unclaimed settlement funds to local charities. In the beginning of 2021, the Institute for Justice (IJ) secured final approval of two consent decrees to end a class action lawsuit on behalf of people who had homes, cash and cars wrongfully seized. While one decree established reforms to prevent abuse in the future, the other created a $3 million fund to compensate forfeiture victims.

Nearly 2,400 individuals received awards that averaged $1,476. The Institute for Justice then selected Philadelphia charities that are working in the city’s most affected communities to receive approximately $282,000 in unclaimed funds.
